BAM Nuttall Limited has been fined after an employee was fatally injured after being run over by a dumper truck.

The company faced a court in Inverness Sheriff Court who heard how on 28th of October 2016 Mr John Camerson was changing a blade on a piece of equipment on the side of a roadway and was run over by a six-tonne dumper truck.

The risks were not adequately assessed

After an investigation by the HSE Executive, it was concluded that the risks associated with repairing and replacing equipment were not properly assessed.

The court ruled that there should have been an appropriate system of work in place when items needed replacing.

The system of work should have provided guidance on the method in which replacements should be made and how workers and vehicles are kept separate.

The incident is reminded of the need to have safe methods of work in place and systems that segregate workers from vehicles and other forms of dangerous equipment that can cause injury.

Dump Truck
Ruling from the court.
BAM Nuttall Limited of St James House, Knoll Road, Camberley, Surrey, pleaded guilty to breaching Sections 2 and 33(1)(a) of the Health and Safety at Work etc. Act 1974 and was fined £700,000.

"This death could easily have been prevented if his employer had acted to identify and manage the risks involved, and to put a safe system of work in place.”
